Terms and Conditions

These Terms & Conditions apply to all bookings made with Icy Pop Face Painting (“the Artist”). By booking, the client (“the Client”) agrees to the following.

1. Services & Booking Requirements

1.1 The Artist provides face and body art services as agreed at the time of booking.
1.2 Minimum booking times:

  • Parties & Private Events: approx. 8–10 faces per hour (more detailed designs). Minimum booking 1.5 hours.
  • Corporate/ Community/ Festivals/ Schools/ Large Events: approx. 10–12 faces per hour (simplified designs). Minimum booking 2 hours.
  • Individual Costume Face Paint: No minimum booking, details and pricing confirmed by Artist individually.
  • Baby Bump & Body Art: minimum booking 2 hours (time varies by design). Details and pricing confirmed by Artist individually.

1.3 Timing depend on design complexity and participant readiness.
1.4 The Client is responsible for managing the queue and ensuring guests are ready to be painted.

2. Additional Time

2.1 Additional time may be requested if the Artist is available.
2.2 Additional time is charged in 30-minute increments. Any time beyond the booked finish — even briefly — is charged as the next 30‑minute block.
2.3 Additional time must be paid before the extra service begins.
2.4 The Artist cannot guarantee all guests will be painted within the booked time.

3. Booking Fees, Payments & Invoices

3.1 A $50 booking fee per day of booking is required to secure your date and must be paid within 24 hours of accepting the booking.
3.2 Booking fees are non‑refundable, but transferable once if rescheduling within 12 months, subject to Artist’s availability.
3.3 Full payment is due 5 days before the event, unless otherwise stated on your invoice.
3.4 Bookings made within 7 days of the event require full payment upfront.
3.5 An invoice will be emailed to the provided address and must be paid promptly to secure the date.
3.6 Overdue payments may incur additional fees.

4. Travel & Additional Fees

4.1 Travel fees apply for locations over 20km from the Artist’s residence in Ambergate, WA.
4.2 A $15 luggage/access fee may apply for long walking distances, stairs, or difficult access.
4.3 Parking fees incurred by the Artist must be covered by the Client.
4.4 Public holiday bookings may incur a surcharge.
4.5 Long‑distance events requiring accommodation may incur additional fees.

5. Setup & Facilities

5.1 A fully covered outdoor area or an indoor space must be provided. The Artist will not work in direct sunlight.
5.2 A minimum painting space of 2m x 2m is required.
5.3 Adequate lighting must be available.
5.4 The Artist requires approximately 15 minutes to set up and 15 minutes to pack down.
5.5 The Client must confirm the venue permits a face/body artist. No refunds will be issued if the venue refuses service due to lack of prior approval.

6. Cancellations

6.1 A minimum of 24 hours’ notice is required to cancel an event. If less notice is given, the Client is liable for the full contracted amount.
6.2 Cancellations within 7 days of the event incur a 50% fee of the total contracted amount.
6.3 The Artist may stop services in extreme weather. No refunds are issued for outdoor events affected by weather, including temperatures over 32°C.
6.4 If the Artist becomes ill before the event and must cancel, all payments will be refunded.
6.5 If the Artist becomes ill during the event, any remaining time of 1 hour or more will be refunded.
6.6 The Artist will attempt to find a replacement, but this cannot be guaranteed.

7. Rescheduling

7.1 A minimum of 7 days’ notice is required to request rescheduling.
7.2 Full payment for the original booking must be made before a reschedule can be confirmed.
7.3 Requests made with less than 7 days’ notice are treated as cancellation.
7.4 Rescheduling is subject to the Artist’s availability.
7.5 If adequate notice is given and the Artist is available, all monies paid will be transferred to the new date.
7.6 A confirmation email will be sent once the new date is approved.
7.7 Cancellations after rescheduling are not eligible for refunds.
7.8 Emergency exceptions may be considered at the Artist’s discretion.
7.9 Additional rescheduling requests will be treated as cancellations.

8. Health, Safety & Liability

8.1 The Artist holds Public Liability Insurance. Proof is available upon request.
8.2 Only cosmetic‑grade, skin‑safe products are used.
8.3 The Artist is not liable for allergic reactions. Patch tests are available upon request.
8.4 Guardians are responsible for knowing any sensitivities and reviewing ingredients if needed.
8.5 In case of irritation, paint should be removed immediately with water and a soft cloth.
8.6 The Artist does not supervise children. Adequate supervision must be provided by the Client.
8.7 The Artist is not responsible for paint deterioration after the Client leaves the chair (sweat, water, touching, eating, clothing changes).
8.8 The Artist is not responsible for paint or glitter transferring onto clothing, furniture, vehicles, or property.
8.9 The Artist will not paint anyone who appears unwell or shows signs of contagious conditions (cold/flu, COVID-19, rashes, cold sores, conjunctivitis, ringworm, sunburn, eczema, open wounds).
8.10 If the Client is aware of infectious conditions among attendees, the Artist must be informed. Failure to do so may result in charges for equipment decontamination or replacement.
8.11 Some colours may lightly stain the skin. Paint should be removed within 12 hours using gentle soap and water.
8.12 The Artist will not paint children under 3 years old, or anyone distressed or unwilling.
8.13 The Artist may stop services and leave without refund if unsafe or inappropriate behaviour occurs and is not resolved promptly.

9. Bouncy Castles & Water Play

9.1 Face paint is not waterproof and may run with sweat or water exposure.
9.2 Please advise if your event includes water play so alternative options can be offered.
9.3 Some bouncy castle companies restrict face paint; please check your waiver.

10. Breaks & End of Services

10.1 The Artist may take bathroom breaks as needed.
10.2 For bookings of 5 hours or more, a 30‑minute meal break is required.
10.3 Sufficient time must be booked to accommodate all guests.

11. Limitations on Artwork

11.1 The Artist will not paint on areas that are illegal to expose or areas they are not comfortable painting.
11.2 The Artist will not paint designs that are obscene, offensive, violent, discriminatory, or inappropriate.

12. Photography & Videography

12.1 The Artist may take photos or videos of completed designs for promotional use.
12.2 The Artist will not photograph children without permission from their parent/guardian and the child’s own comfort consent.
12.3 Guests and event photographers may take photos of the Artist at work. Credit to Icy Pop Face Painting is appreciated when shared.
12.4 For events where caregivers are not present, the Client must:
– Inform caregivers that photos may be taken
– Inform the Artist of any children who must not be photographed

13. Use of Images & Attribution

13.1 Photos or videos taken of the Artist or the Artist’s work may be used by the Client for event promotion, provided Icy Pop Face Painting is clearly credited.
13.2 All copyright and intellectual property rights in the artwork remain with the Artist.
13.3 The Client must ensure any hired photographers or media comply with these requirements.
13.4 Unauthorised use, failure to credit, or misrepresentation of the Artist’s work is not permitted. The Artist may request removal of such images. Continued misuse may result in further action.
